This website is operated by By Aimee, LLC, doing business as Pilates by Aimee ("Pilates by Aimee"). Throughout the site, the terms "we," "us," and "our" refer to Pilates by Aimee. Pilates by Aimee offers this website, including all information, tools, classes, workshops, retreats, memberships, and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site, booking a class, purchasing a membership, or otherwise engaging with our Services, you agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site and Services, including without limitation browsers, members, drop-in clients, workshop participants, retreat attendees, and any other party engaging with Pilates by Aimee.
Please read these Terms of Service carefully before accessing or using our website or Services. By accessing or using any part of the site or by booking any class, workshop, retreat, or membership, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any Services.
We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website or Services following the posting of any changes constitutes acceptance of those changes.
Section 1 – Online Booking and Account Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, or that you have given us consent to allow any of your minor dependents to use this site or attend classes under your supervision and responsibility.
You may not use our Services for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.
A breach or violation of any of these Terms will result in immediate termination of your Services.
Section 2 – General Conditions
We reserve the right to refuse Service to anyone for any reason at any time, including but not limited to disruptive behavior, repeated cancellation violations, or any conduct that compromises the safety, comfort, or experience of other clients or the instructor.
You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our Services, content, instructional materials, or workshop content without express written permission from us.
Section 3 – Health Disclaimer and Assumption of Risk
Pilates by Aimee provides mat Pilates instruction, workshops, and related wellness services. We are not medical professionals. No information provided through our Services — including class instruction, workshop content, written materials, or conversations with the instructor — is intended as medical advice, diagnosis, or treatment.
You are responsible for consulting with your physician or qualified healthcare provider before beginning any exercise program, including Pilates. By participating in any class, workshop, or retreat, you affirm that you are physically capable of participating and that you have disclosed any relevant medical conditions, injuries, pregnancies, or limitations to the instructor in advance.
You acknowledge that participation in Pilates and related physical activity involves inherent risks, including but not limited to muscle strain, joint injury, falls, and aggravation of pre-existing conditions. You voluntarily assume these risks and release Pilates by Aimee, By Aimee, LLC, and their officers, employees, contractors, and agents from any liability arising from your participation.
If at any point during a class you experience pain, dizziness, shortness of breath, or any other symptom that concerns you, you agree to stop the activity immediately and inform the instructor.
Section 4 – Memberships, Pricing, and Class Packages
Prices for our Services are subject to change with reasonable notice. Active members will receive advance notice of any changes to recurring membership pricing.
Founder Rate (April 2026 Cohort): Members who purchased the April 2026 founder rate of $100/month are entitled to that rate through December 31, 2027, provided their membership remains active and continuous. "Active and continuous" means: monthly payments process successfully each month without a paused, cancelled, or missed billing cycle. A failed payment that is resolved within 5 business days does not count as a gap. If a founder membership lapses for any reason, returning members will rejoin at current standard pricing.
3-Month Contract Memberships: Members who purchase a 3-month contract membership commit to three consecutive monthly payments. Cancellation prior to completing the three-month term is not permitted. After the initial three-month term, the membership converts to month-to-month and may be cancelled with 30 days' written notice.
Month-to-Month Memberships: May be cancelled with 30 days' written notice to pilatesbyaim@gmail.com.
Class Packages: Packages expire 30 days from date of purchase. Unused classes do not roll over and are non-refundable. Packages are non-transferable.
Drop-In Classes: Single-class drop-ins are non-refundable but may be rescheduled in accordance with our cancellation policy.
Workshops: Workshop registrations are non-refundable within 48 hours of the workshop start time. Outside the 48-hour window, registrations may be transferred to a future workshop of equal value.
Retreats: Retreat deposits are non-refundable. Final payment is due 30 days prior to the retreat start date. Cancellations made more than 30 days prior to the retreat are eligible for a partial refund less the non-refundable deposit. Cancellations within 30 days of the retreat are not refundable.
Section 5 – Cancellation and No-Show Policy
Due to our small class sizes (maximum 7 students per class), we ask all clients to honor our cancellation policy:
Cancellations made more than 12 hours before class start time: no fee, full credit returned
Cancellations made less than 12 hours before class start time: counts as a used class for package or drop-in clients
No-shows: counts as a used class for package or drop-in clients
If you are on a waitlist and a spot opens up, you will be notified and automatically added to the class. Please consider waitlist registration a commitment.
Section 6 – Studio Policies
Please arrive 5–10 minutes before class start time. Late entry may not be permitted for safety reasons.
All clients must complete a health intake form before their first class. It is required to have a yearly form update and/or when any significant health changes occur.
Mats are provided. You are welcome to bring your own.
Please silence phones during class.
Personal belongings are stored at your own risk; Pilates by Aimee is not responsible for lost or damaged items.
Section 7 – Errors, Inaccuracies, and Omissions
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions related to pricing, schedules, descriptions, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice. We undertake no obligation to update, amend, or clarify information except as required by law.
Section 8 – Intellectual Property
All content created by Pilates by Aimee — including class sequences, workshop materials, written content, branding, photography, and video — is the intellectual property of By Aimee, LLC. You may not reproduce, distribute, teach, or commercially use this content without express written permission.
Section 9 – Third-Party Links and Services
Our site and Services may include links to third-party websites (including our booking platform, payment processor, and email service provider). We are not responsible for the content, accuracy, or practices of third-party websites or services. Please review their respective policies before engaging with them.
Section 10 – Prohibited Uses
In addition to other prohibitions set forth in these Terms, you are prohibited from using the site, Services, or content: (a) for any unlawful purpose; (b) to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate against any person; (c) to submit false or misleading information; (d) to upload viruses or malicious code; (e) to collect personal information of others; or (f) to interfere with the security or functionality of the site or Services. We reserve the right to terminate your use of the Services for any violation.
Section 11 – Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent, or warrant that your use of our Services will be uninterrupted, timely, secure, or error-free.
The Services are provided "as is" and "as available," without any representation, warranties, or conditions of any kind, either express or implied.
In no case shall By Aimee, LLC, Pilates by Aimee, or their directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Services, including but not limited to physical injury sustained during class participation, except to the extent prohibited by applicable law. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states our liability shall be limited to the maximum extent permitted by law.
Section 12 – Indemnification
You agree to indemnify, defend, and hold harmless By Aimee, LLC, Pilates by Aimee, and our officers, directors, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Section 13 – Severability
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
Section 14 – Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services.
Section 15 – Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and us, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written.
Section 16 – Governing Law
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved in the state or federal courts located in Marion County, Florida.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of our Services following the posting of any changes constitutes acceptance of those changes.
